Fiadores\" title=\"\"><\/div>\n<div class=\"col-md-8\"><\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"row\">\n<div class=\"newsreel\">\n<p>El determinant per a la transpar\u00e8ncia d&#8217;una cl\u00e0usula de fian\u00e7ament del pr\u00e9stec \u00e9s que el fiador sigui conscient que, si el deutor principal no paga, respon en les seves mateixes condicions i el creditor podr\u00e0 dirigir-se contra ell per la totalitat del deute pendent.<\/p>\n<p>Aix\u00ed ho ha expressat en una recent sent\u00e8ncia el Tribunal Suprem (TS) posant, fi a les pretensions d&#8217;un consumidor que es declaressin nul\u00b7les les cl\u00e0usules del contracte de pr\u00e9stec hipotecari que va signar amb un banc.<\/p>\n<p>La quantia del pr\u00e9stec superava el valor de taxaci\u00f3 de la finca a adquirir, per la qual cosa el banc va requerir garanties addicionals, en concret, la hipoteca sobre una finca dels pares d&#8217;aquest.<\/p>\n<p>Per al TS la cl\u00e0usula controvertida supera el control de transpar\u00e8ncia, perqu\u00e8 \u00e9s clara i comprensible.
